Rule 13
Investigation and decision
:
(1) The Commission shall examine the application submitted by the political party and make a decision regarding party registration as follows:-
(a) Disclosure or non-disclosure of what is required to be disclosed in the application,
(b) Whether or not the party has fulfilled the conditions necessary for registration,
(c) The application submitted by the political party for party registration and the attached details, documents whether completed or not.
(2) According to sub-rule (1), if it is found suitable after examining the application, the Commission shall register such political party for election purposes.
(3) If the Commission does not find that the application, documents and details received for registration are sufficient, it may conduct further investigation on the matter deemed necessary with the political party submitting the application or understand what it deems necessary.
(4) If the political party submitting the application cannot be registered due to the reasons and conditions, the Commission shall give such party a maximum of seven days to submit its statement along with evidence.
(5) The Commission will decide whether or not to register such a party based on the statement submitted by the political party and the attached evidence within the time allowed to submit the statement.
(6) A political party that does not submit its statement within the time given by the commission will not be allowed to submit its statement later.
(7) Failure of any political party to submit its statement within the time given by the Commission shall not be deemed to hinder the Commission from making a decision regarding whether or not to register such a party for election purposes.
(8) The Commission shall publish the names of the political parties registered for election purposes in the Nepal Gazette (9) If the Commission does not register the political party submitting the application, it shall inform the relevant political party within seven days.
(10) The decision made by the commission regarding registration of political parties shall be final.
